What can I claim for?
If you suffered an accident or illness that was due to negligence or was caused by your service provider, you can claim for a number of things that you may be unaware of. What are my rights for claiming abroad?
When making a package holiday claim, there are two regulations in particular that provide legal support. These are The Package Travel Regulations Act 1992, and The Athens Convention 1974.
Most all-inclusive and package holidays booked through a UK tour operator are covered by The Package Travel Regulations Act 1992 which covers anyone who has fallen ill or become injured on a package or all-inclusive holiday and their holiday provider has been proven to be at fault. You have three years from the date of your illness to make a claim, so make sure to call us even if you are unsure whether it’s too late. This regulation determines that a “package” holiday is the pre-arranged combination of a minimum of at least two of the following services: transport, accommodation or other tourist services that account for a significant proportion of the package.
According to this regulation, a holiday package is when the above is sold or offered for sale at an inclusive price and when the service covers a duration of more than twenty-four hours or includes overnight.
Simply said, you must meet the three criteria of making your claim within three years from your injury or illness date, your holiday must be all inclusive or full board, and it must be determined as a package from your tour provider.
To make a claim under the Package Holidays Regulations 1992, you must be also able to prove that you became ill or injured in the hotel as a direct consequence of their processes or negligence. If you did not take out travel insurance, there is still a good chance of receiving compensation, although you should discuss this with a lawyer when possible.
How much am I entitled to?
The average package holiday compensation claim in the UK is around £2,500. However, the amount of money that you are entitled to will be dependent on a number of factors that are reliant on exactly what you are claiming for.
