In October 2018 the government will increase the “small claims” limit in road traffic accidents from £1,000 to £5,000. This means that in personal injury claims under £5,000, you cannot claim your legal costs from the insurers and you have to pay them yourselves. This will mean paying more in costs out of your whiplash compensation claim.
In some cases, personal injury solicitors will reject claims that are not economical to bring. Claimants would then have to represent themselves against insurers and this is likely to lead to insurers under-settling or rejecting genuine compensation claims.
Secondly, the government will dramatically reduce the payouts for whiplash compensation claims. The proposed cut in whiplash compensation means that someone injured in a car crash could suffer pain for 9 months and receive over £2000 now but after October 2018 they will only be paid £500.
