Government plans to ban whiplash claims

The government has announced two key changes to the personal injury claims process in 2016. The reason given for these changes is to allow the insurance industry to make costs savings of about £40 to £50 per person, which they will pass on to their customers.

Firstly the government will increase the “small claims” limit from £1,000 to £5,000. This means that in a claim under £5,000, you cannot claim your legal costs from the insurers.

Secondly, the government are planning to ban compensation for whiplash claims completely.

If the small claims limit was increased, someone with a personal injury claim of less than £5,000 could not claim their legal costs from the insurance company and would have to pay those costs out of their damages. This could wipe out most of the compensation and in some cases, accident claims solicitors will reject claims that are not economical to bring. Claimants would then have to represent themselves against insurers and this is likely to lead to insurers under-settling or rejecting genuine claims.

The government plans to ban compensation for whiplash claims but to allow claimants to have treatment and claim for lost earnings. The government argues this will prevent fraudulent claims but ignores the fact it will prevent compensation being awarded in the vast majority of genuine compensation claims and there are other ways insurers can tackle fraud.

The proposed ban on whiplash compensation means that someone injured in a car crash could suffer pain for 2 years but be prevented from obtaining compensation yet the same person could claim compensation for an accident in a shop, which caused pain for only for a few weeks. This proposed change would leave the law making no sense at all.

Mark Hunter, solicitor and owner of Mackrell and Thomas, no win no fee solicitors in Liverpool, says that the government plans to remove the rights of ordinary accident victims to claim for accident compensation is the breach of an individual’s right which has been in place for over 100 years. It could mean the end of “no win no fee” representation in many claims.

The proposed changes are also likely to see local Liverpool accident solicitors losing their jobs and even whole firms of injury solicitors being closed down, with the obvious loss to the local economy.

The change is being made primarily to increase the profits of insurance companies who are often based abroad and pay very little tax. Based on previous experience of changes to the personal injury claims process, the insurers are not likely to pass on any real savings in insurance premiums to the public.
